Terms & Conditions

General Terms

These Terms govern access to and use of services provided by pensamo through pensamo.click, including accommodation, day programs and ancillary services for seniors. They describe responsibilities, payment terms, and procedures for common scenarios such as short stays, care coordination with family members, and third-party vendor use. Decisions are documented to support transparency in case handling.

Eligibility

Use of pensamo services requires that users meet age and legal capacity requirements and provide accurate information during booking. Cases where support is provided by a legal representative will require documentary proof such as power of attorney or guardianship papers.

pensamo services are intended for adults and seniors. Individuals under 18 may not register as primary account holders; third parties may arrange services on behalf of dependents with appropriate authorization.

Services must be used lawfully and in line with facility rules. Practical examples: disruptive behavior or use of services for commercial solicitation may result in denial of certain privileges after review.

Access to certain services may be limited by local regulations and geographic eligibility. For international bookings, guests should confirm visa and travel requirements independently.

Account and Access

Account holders must maintain accurate account information. pensamo uses accounts to manage bookings, health preferences, and family contacts. In practice, family coordinators often maintain accounts for residents and must keep authorization documents up to date.

You are responsible for maintaining accurate and current information. In one scenario, a resident’s emergency contact was outdated and delayed response coordination; accurate data helps avoid such outcomes.

Protect your account credentials and notify pensamo immediately if you suspect unauthorized access. We use standard security measures and will contribute incidents and advise on mitigation steps.

Accounts are personal and may not be transferred without prior written approval. Case: transfer requests for institutional coordination were handled through formal account delegation processes.

If your account is compromised, contact support immediately and provide identifying details. We will suspend access as necessary and guide you through recovery and security hardening.

pensamo may suspend accounts that breach terms or pose safety risks. Suspension decisions are documented and communicated, with an appeals process described below.

Services Offered

pensamo provides assisted living orientation, day programs, wellness classes, and short-stay sanatorium accommodations tailored for retirees. Service descriptions include practical examples of activities and the typical scope of support, such as mobility assistance and scheduled check-ins.

Service offerings and schedules may change. We notify affected guests in advance when possible and provide alternatives or refunds as appropriate for the specific case.

Availability depends on capacity, seasonal demand, and regulatory constraints. Example: peak periods may require advance booking and limited day-program slots.

House Rules

To ensure a safe and comfortable environment, guests must follow facility rules. Below are specific expectations with practical examples.

  • Respectful behavior toward staff and fellow guests; repeated disruptive conduct may lead to restricted access after review.
  • Compliance with safety protocols, including evacuation procedures and infection control measures when required.
  • No illicit substances on premises; violations will involve local authorities when necessary.
  • Responsible use of communal facilities; damaged property may incur repair charges based on documented cases.
  • Visitors must register and follow visiting hours; exemplary case: coordinated family visits that respect quiet hours.
  • Pets allowed only with prior approval and where suitable for communal living.
  • Photography and recording permitted only with consent from those recorded; privacy incidents are contribute and addressed.

User Content

User content includes reviews, photos, and messages posted on pensamo platforms. We describe ownership, licenses, and responsibilities with scenario-based guidance for common cases.

Users retain ownership of their content but grant pensamo a license to display it as needed to provide services and improve user experience. Example: a family photo posted to a private album remains owned by the uploader but may be used in internal scheduling when authorized.

By posting content you grant pensamo a non-exclusive license to host, distribute and display the content in connection with service operations. This license helps pensamo manage guest profiles and communications.

Users are responsible for the lawfulness of content they post. In practice, content found to be defamatory or infringing will be removed after review and notification.

Requests to remove content should be submitted with identification and a reason. We evaluate removal requests with reference to retention needs and lawful obligations.

Intellectual Property

All pensamo branding, site designs, and materials are protected by intellectual property rights. Use of pensamo activity or copyrighted content requires prior written permission except where permitted by license.

  • Do not copy or reproduce pensamo branding for commercial use without authorization.
  • Third-party content is subject to the rights held by those parties; obtain licenses where necessary.
  • Reports of infringement should be sent to our designated IP contact for review and action.

Paid Services

Certain pensamo services are fee-based, including extended stays, specialized classes, and premium room options. Pricing and payment terms are made clear at booking and illustrated with sample billing scenarios.

Prices are quoted per service and may include optional add-ons. Case example: a guest selecting physiotherapy sessions sees per-session pricing and estimated package costs before confirmation.

Payments are accepted by approved methods at checkout. For bookings made through third parties, separate payment terms may apply. Receipts are provided and retained according to accounting practices.

Recurring services require explicit enrollment and clear cancellation terms. Example: a weekly transport subscription can be paused with 14 days’ notice as specified in the subscription agreement.

Refunds are assessed based on the nature of the service, cancellation timing, and documentation. In a typical scenario, cancellations made with sufficient notice may qualify for partial refunds after administrative fees are applied.

Cancellations should be submitted in writing. Cases involving health-related cancellations may require supporting documentation to evaluate refund eligibility.

Applicable taxes are added to the price where required by Thai law and are itemized on invoices. Guests are responsible for local taxes that may apply to their bookings.

pensamo may adjust prices; price changes do not affect confirmed bookings unless required by law. Price updates are communicated on pensamo.click with examples of how they affect future bookings.

Non-payment may result in suspended services and collection actions. We document attempts to resolve unpaid balances and use escalation steps consistent with consumer protection practices.

Disclaimer

pensamo provides accommodation and wellbeing services but does not provide medical diagnosis. Descriptions of services are illustrative and based on typical case outcomes, not promises of specific medical results. Guests should consult healthcare professionals for medical advice.

Limitation of Liability

To the extent permitted by law, pensamo’s liability for direct damages arising from use of services is limited to amounts paid for the affected service. Liability for indirect or consequential losses is excluded in most cases, subject to mandatory legal protections.

Third-Party Services

pensamo may work with third-party vendors for transport, supplies, and specialist services. Practical case: an external physiotherapy provider runs supervised sessions on site; liability and data sharing are governed by a vendor agreement and disclosed to participants.

Termination

Either party may terminate service agreements in accordance with the cancellation provisions. In case-based reviews, termination decisions are recorded with reasons and actions taken to ensure continuity of care where applicable.

Termination may result in account closure, final billing, and removal of access to facilities. We provide guidance for transfer of records to another provider when requested by the guest or authorized representative.

Privacy

pensamo’s privacy policy governs collection and handling of personal data. The policy includes practical steps for rights requests, examples of typical disclosures to healthcare partners, and timelines for responses to data access or correction requests.

Communications

Communications may include email, phone calls, and postal notices. Preferences can be updated in account settings. In documented scenarios, families used designated communication channels to coordinate care without sharing secure access credentials.

Changes to Terms

We update these Terms as needed. Material changes are announced on pensamo.click with an effective date. Routine updates are logged with examples of why changes were made, such as regulatory updates or operational improvements.

Governing Law

These Terms are governed by the laws of Thailand. Disputes are first addressed through internal dispute resolution, with escalation to local courts when necessary. Case examples of dispute resolution are used to refine our processes.

Dispute Resolution

If a dispute arises, contact our support team to begin internal resolution. If unresolved, parties may seek mediation or pursue legal remedies under Thai law. We document dispute cases to identify systemic improvements.
